China formally initiated a dispute in the World Trade Organization (WTO) for the tariffs imposed by the president of the United States Donald Trump to his products, the agency with headquarters in Geneva said Wednesday.

Trump ordered Saturday to impose tariffs on products from Mexico, Canada and China, demanding that they stop the fentanyl flow and, in the case of their neighbors, illegal immigration.

He subsequently froze the tariffs against the two American countries, but continued with China’s.

China, object of 10% tariffs on exports of goods by Trump, had promised to challenge the measure in the WTO.

In a statement cited by the WTO, China said the measures seemed incompatible with the obligations of the United States under the agreement that led to the creation of the commercial body, pointing out the discriminatory nature of tariffs.

“China reserves the right to raise additional measures and claims in relation to issues identified here during the course of consultations and in any future request for establishing a special group,” said the Chinese statement, which did not detailed what measures could take .

Since December 2019, the WTO difference solution system is paralyzed after the collapse of its appeal organ, which has the last word in disputes.

Trump’s first government and Joe Biden blocked the appointment of new judges for the appeal body so they considered a judicial overreach in disputes. The body cannot function with less than three judges.
