The United States government announced the successful resolution on a case of denial of rights related to freedom of association and collective bargaining in an auto parts factory in Iztapalapa.
The Commercial Representation of the US (USTR) submitted an application to Mexico to review the issue in Aludyne Automotive Mexico City under the TMEC rules.
The USTR added that the Government of Mexico accepted the application, found the denial of rights and collaborated with the rapid response labor mechanism (MRR) of the commercial agreement to adopt corrective measures, which EU reviewed and concluded that the situation had been remedied.
In a statement, the commercial representation reported Monday that the investigation began on March 3, after the Union of Workers of the Metal Industry, Steel, Iron, Related and the Similar (Stimahcs), affiliated with the Authentic Front of the Labor (FAT), presented a request alleging violations of labor rights.

Among them, the attempt to replace union leaders, punish negotiators, limit participation in workers’ committees and intimidate with threats and reprisals.
The Interinstitutional Labor Committee for Monitoring and Compliance (ILC), led by the Commercial Representation and the US Labor Secretary, determined that there was credible evidence of a denial of rights, so that on April 2 he formally requested the Government of Mexico a review of the case.
Mexico accepted the petition, confirmed the existence of irregularities and collaborated in the implementation of corrective measures. As part of the solution, Aludyne was forced to:
- Reincorporate a worked worker for trade union activity, and pay back salaries and other benefits.
- Adopt and implement a letter of neutrality and behavior policies that promote freedom of association and collective bargaining, including a zero tolerance policy against violations.
- Train all your staff about labor commitments and new guidelines.
- Negotiate with the union a rescheduling of schedules so that workers have greater access to union delegates, as well as paid time for union representatives to exercise their functions during the working day.

Once the fulfillment of these actions was verified, the head of the USTR, Jamieson Greer, instructed the Treasury Department to resume the liquidation of entries of unprocessed goods from Aludyne. Washington concluded that there is no longer a denial of current rights.
