Austin, (EFE) .- A federal judge at Washington DC issued on Wednesday a ruling against the prohibition of asylum requests at the southern border, imposed by President Donald Trump in January.
In an extensive ruling, Judge Randolph Moss stipulated that the Republican’s decision exceeds the presidential powers and violates the EU immigration law, which allows migrants to request asylum when they are on American soil.
In the document, Moss said that he recognizes the “great challenges” facing the Executive when it comes to “prevent and deter” irregular immigration to the US.
However, he concludes, “neither the Constitution nor the immigration law give the President authority to replace the laws and procedures” already established by the Congress.

A presidential proclamation, by itself, “cannot affect the right of non -citizens to request asylum, their eligibility for asylum or asylum procedures,” the judge insisted.
The day the presidency assumed, Trump signed a presidential decree to declare an “invasion” on the southern border, suspend the right to asylum and order the immigration authorities “repel, repatriate or expel” the foreign persons who arrive in the country by this route.
Today’s ruling, against this measure, comes after a group of three organizations, on behalf of 13 asylum seekers, filed a lawsuit against the decree.
This decision adds to other judicial resolutions that have tried to block the agenda of President Trump, focused on fulfilling his promise to deport more than 11 million migrants living in the US without a legal status.
Since his arrival to power, the number of irregular crosses on the southern border of the US has collapsed to historical minimums, according to official data.
