The federal government said that it is committed to the protection of intellectual property rights of both the national industry and that of its commercial partners, and that the greatest surveillance that EU put on Mexico in the matter did not take into account actions carried out.

The Government indicated that in the visit made to Washington DC, the Undersecretary of Foreign Trade, Luis Rosendo Gutiérrez, will meet with officials of the Commercial Representation of EU (USTR) to reiterate Mexico’s commitment to the protection of intellectual property and to inform about measures that were not considered in the US report published on Tuesday.

The USTR transferred Mexico from a list of surveillance on intellectual property to a higher priority, citing former concerns about the application of the law against falsification of brands and the protection of intellectual property related to pharmaceutical products.

The US concerns in this matter could be a factor in the government negotiations of President Donald Trump with many countries about non -tariff tariffs and barriers, which gives the report a greater importance this year.

The priority list now includes Mexico, China, Chile, Argentina, India, Indonesia, Russia and Venezuela.

The commitment of the administration of Claudia Sheinbaum can be verified in the application of the cleaning operation against merchandise illegally introduced to the country, or that violates intellectual property rights, the Secretariat of Economy and the Mexican Institute of Industrial Property presented on Tuesday.

The Government said that the majority of the OSTR observations are in the process of solution.

He explained that Mexico made legislative reforms, with amendments to the Federal Copyright Law, as well as the promulgation of the Federal Law on Industrial Property Protection and a project to reform it, instructed by President Sheinbaum.

He added that the respective regulation is in the opinion by the Legal Ministry, “so it is soon to be published”, and that the Supreme Court confirmed the constitutionality of the Federal Copyright Law.

On intellectual property regarding pharmaceutical products, the Government said that Mexico has a five -year transition period in the TMEC, which expires on July 1, 2025, to implement protection policies that, he said, are underway.

In this area, economy and the IMPI recalled that in March a cooperation agreement on the sanitary registration process that guarantees transparency and efficiency in the regulation of medications and industrial property was published.

In addition, a portal was created that incorporates the patents associated with medications where the current patents can be located, the next ones to win, which are already in public domain and the responses that the Federal Commission gives to the Federal Commission for Protection against Health Risks within the framework of the linking system.

The government argued that the consultation is facilitated with that portal and the rights holders already interested in investing in the elaboration of generic medicines are given.

He stressed that the USTr report does not imply commercial measures that may affect Mexico.
