The federal judge Brian M. Cogan, who presides in New York the case for drug trafficking against Ismael ‘El Mayo’ Zambada, set for August 25 the next hearing, after the request made this Wednesday by the Prosecutor’s Office and the defense of the co -founder of the Sinaloa Cartel.

Judge Cogan thus responded after receiving this Wednesday a letter in which he was asked to be postponed for at least 60 days “or on the most convenient date” the hearing in the Federal Court for the East District of New York, in Brooklyn County, where the judge himself presided over the trial against Joaquín ‘El Chapo’ Guzmán, former Socio of ‘El Mayo’.

It is the second time this year that the date of the audience is changed. The previous one was scheduled for April 22, and was transferred to June 16 at the request of its defense, and now the new date has been fixed again, for the midday of August 25.

In today’s letter, the parties remember that they have exchanged new evidence and have also discussed the possibility of reaching an agreement before the trial, in which ‘May’, 77, would be tried for 17 charges related to drug trafficking.

The Prosecutor’s Office also indicated to Judge Cogan, who condemned perpetual chain to ‘El Chapo’ Guzmán, with whom Zambada founded the Sinaloa Cartel, that this legal process has occurred while the Government evaluation of a possible request for capital punishment for the accused is still pending.

‘The May’ could face the death penalty for the crimes of organized crime, money laundering and drug trafficking and, as it has transcended, his defense has indicated that his client does not want a trial that could conclude with a conviction of capital punishment, so he would be willing to reach a guilt agreement with the authorities.

In February ‘El Mayo’, – in July 2024, when he arrived in the US, together with Joaquín Guzmán López, son of ‘El Chapo’, what he says happened under deception – wrote to the government asking for his repatriation in an attempt to avoid the death penalty.

The Prosecutor’s Office also indicated to Cogan in the letter that all this also happens while the Government evaluates the probability and scope of procedures in accordance with the Law on Classified Information Procedures (CIPA in English).

CIPA, approved by Congress in 1980, is a law that establishes procedures for the admission and management of information classified in federal criminal procedures.
