An American federal judge blocked on Monday part of several executive orders of President Donald Trump against the programs of diversity, equity and inclusion (DEI) and what he calls the ‘gender ideology’, after the complaints of several LGTB organizations.
Judge Jon Tigar, from the Court of Northern California, considered that the content of three orders, focused on withdrawing government financing to diversity support services and transgender people, constitutes “censorship” and goes against freedom of expression, constitutionally protected.
“Although the Executive requires a certain degree of freedom to implement its political agenda, it is still limited by the Constitution,” said Tigar, who considers that he cannot “manipulate” funds designated by Congress to “isolate” communities or “suppress ideas that do not like.”
The judge also prevents the Department of Justice from canceling its blockade to the application of these executive orders while the case lasts, although the Government is expected to appeal the decision.

One of the LGTB Defense Defense Organizations, Lambda, which receives federal funds, said that executive orders threatened to dismantle “vital” health services and help for the population with HIV, among other things, something that the judge recognized.
“This loss (of services) not only threatens the survival of key programs but also forces complainants to choose between their constitutional rights and the continuation of their existence,” said Tigar.
Nine six -states LGTB organizations denounced Trump’s executive orders last February, arguing that obeying them endangered their missions, which include HIV prevention and treatment services, accommodation and mental health to vulnerable populations.
