The president of the Chamber of Deputies, Kenia López Rabadán, expressed her rejection of the recent modifications to the Amparo Law, arguing that they attack a fundamental legal resource and a source of pride for Mexicans, according to a report from the news agency Quadratín México.

The legislator assured that she voted against considering that the changes represent a setback.

He explained that the reforms hinder the presentation of amparos, restrict the power of judges to suspend acts of authority and contravene article 14 of the Constitution, which prevents the retroactive application of the law to the detriment of any person.

López Rabadán highlighted that the amparo trial has historically been an essential tool to protect human rights against possible excesses of power, defending basic guarantees such as life, health, property and access to education.

Possible challenges

López Rabadán anticipated that the reforms are likely to be challenged through new amparo trials, which will test both the Judiciary and its independence.

Finally, he stressed that the discussion on the constitutionality of these changes will be key to evaluating the functioning of democratic checks and balances in the country.
