The parastatal that controls Mexicana de Aviación must publish the contracts that the airline made with Petrus Aero Holdings and any other firm for the leasing of aircraft, the Plenary of the Inai resolved.

The requester of the information filed a complaint with the transparency institute, which is soon to disappear, because the Olmeca-Maya-Mexica Airport, Railway, Auxiliary and Related Services Group (GAFSACOMM) reserved the information about the lease.

The public company argued that this information is part of a judicial file derived from a lawsuit against Mexicana de Aviación for the alleged breach of contractual obligations, according to a statement from the National Institute of Transparency, Access to Information and Protection of Personal Data ( Inai).

In the analysis of the case, the presentation by Commissioner Norma Julieta del Río Venegas determined that the reservation of the contracts is inadmissible, since it is information of a public nature since its creation.

He warned that, although there is a trial in United States courts for the lawsuit against the state airline, the contracts were signed before the legal controversy and do not refer to an action, diligence or record typical of the jurisdictional procedure, so it cannot be validate the reservation.

He indicated that publishing and updating contracts is an obligation provided for in the Federal Transparency Law.

“It has the objective of making the actions of the authority transparent in the processes of contracting goods or services, which means nothing other than the transparency of the use and destination of public resources,” said the commissioner.

The INAI plenary session unanimously revoked GAFSACOMM’s response and ordered it to deliver to the applicant a copy of the contracts that Mexicana de Aviación entered into with Petrus Aero Holdings and with any other company for the leasing of aircraft.
