The arbitrator’s final report determined that some of the elements of the decree issued by Mexico in February 2023 on the use of glyphosate and transgenic corn cannot be applied because they are not based “on an adequate risk assessment, scientific evidence and relevant international standards.” The ministries of Economy and Agriculture stated in a joint statement.

“The Government of Mexico does not share the panel’s determination, as it considers that the questioned measures are aligned with the principles of protection of public health and the rights of indigenous peoples, established in national legislation and in the international treaties of which “It is part,” the government said.

“Despite this, the Government of Mexico will respect the determination, since the dispute settlement system of the USMCA is a key piece of said treaty, as was demonstrated in the case on Rules of Origin of the automotive sector that was favorable for Mexico. ”he added.

The government reiterated its commitment to protecting essential values ​​such as health, public morality, the conservation of natural resources, the culture of the Mexican population and the rights of indigenous peoples, which, it maintained, were recognized by the panel as concerns legitimate.
