The Congress of Michoacán decriminalized abortion by voluntary decision this Thursday, in line with 14 other states in the country and with the ruling of the Court that a year ago ordered the federal Congress to eliminate the crime from the Penal Code.

With 27 votes in favor, six against and three abstentions, the Michoacán legislature approved the opinion proposed by the Morena parliamentary group, which eliminates the prohibition on the interruption of pregnancy until week 12.

During the vote, after a long session that began in the morning, Representative Brisa Arroyo, from the PRD, recalled that since 2021 the Court declared unconstitutional “the criminalization of women for making decisions about their body.”

“Outside this premises there are many women putting their lives at risk, undergoing clandestine termination of pregnancy, with fear, but above all with the terror of facing a society that, with moralistic speeches, subjects us women to the stake. for exercising sexuality freely,” said Arroyo.

From the independent bench, deputy Conrado Paz Torres expressed his vote in favor of the decriminalization of abortion, but said he was against “the promotion of it,” and in the same sense, Carlos Alejandro Bautista considered that after the 12th week It is “a murder.”

While representative Ana Vanessa Caratachea, from the PAN, showed her vote against and expressed that she will seek to “save both lives” and that she will march on 8M on International Women’s Day, but will also protest alongside pro-life groups.

Outside the legislative chamber, pro-life and pro-abortion groups demonstrated during the discussion to show their position on the ruling.

In a statement, the group of feminist groups and activists ILEMich asked Congress to legislate, not only for the decriminalization of abortion, but also to “guarantee the possibility of access to it.”

“Decriminalizing abortion is not enough. “This “half-baked” vote continues to condemn thousands of Michoacan women to forced motherhood for not guaranteeing their right to decide about their lives,” they indicated.

Now there are 15 entities in the country that have decriminalized abortion as a voluntary decision of the woman or pregnant person, by legislative means.

However, in Zacatecas, Nayarit and Yucatán it has been decriminalized through the courts, after the courts ordered Congress to eliminate the crime of abortion from the local Penal Code, without this happening yet.

In addition to the 2021 ruling, in September 2023, the Supreme Court issued another ruling for federal health institutions to guarantee the right to safe abortion, and for the federal Congress to reform the Penal Code to eliminate the crime of abortion, which It hasn’t happened.
