The Senate received this Friday the reform of President Claudia Sheinbaum to eliminate the Federal Economic Competition Commission (Cofece) and create in its place the new National Anti -Ponopoolio Commission.

According to the initiative, this new commission will be a decentralized public body attached to the Ministry of Economy with extended powers and reinforced structure, which leaves aside the old “autonomous body and oblivious to the State”, according to the document.

The project provides that the National Anti -Ponopoopoly Commission has a Plenary composed of five commissioners, appointed by the President and ratified by the Senate. His assignment would be for seven years non -extendable.

The document sent by Sheinbaum ensures “the separation between the authority that investigates and the one that sanctions, as well as its technical independence, autonomy of management and its own heritage.”

Among the new provisions, the new commission may raise the procedures for verification of compliance, qualification of confidential information and completion of surveys and data collection to the rank of law.

In addition, their powers are strengthened to practice inspection visits, require documents and coordinate with international authorities.

The sanctions harden and include fines of up to 300,000 units of measurement and update (UMA), equivalent to almost 33.9 million pesos, as well as temporary disqualifications in public tenders.

The document sent by the president argues that “the extinct Cofece today became an entity outside the State that sometimes protected private interests over general well -being.”

Instead, he mentions the presidential reform, the new commission recovers the economic rectory of the State, “to correct the abuses of power, which had become a norm, by groups that only saw for their interests.”

The new provisions that are promoted seek to expand the investigation terms of illicit concentrations of one to three years, the thresholds for notification will be updated, and collective actions mechanisms are incorporated so that consumers can claim damage without waiting for the firmness of the administrative resolution.

In terms of telecommunications and broadcasting, the National Antimonopoolian Commission is responsible for supervising the preponderance of companies and market concentration.

The change must be discussed in the commissions of the Senate and then approved in the Plenary and then follow the same process in the Chamber of Deputies, prior to its promulgation and entry into force.

With this reform, the Government also intends to meet international standards of the Organization for Economic Cooperation and Development and the commitments of the Mexico and Canada Treaty, in order to promote economic competence and autonomy in the decisions of this new decentralized public body.
