S2 Capital’s Scott Everett Sues Jakub Kostecki For Defamation

Months of online quarrels within the real estate community on X, formerly known as Twitter, have finally escalated into a lawsuit. 

Scott Everett, the CEO of S2 Capital, is suing the person believed to be behind the popular #RETwit account LPWhisperer, Jakub Kostecki, in district court for the Northern District of Texas.

In the suit, Everett claims Kostecki is a serial scammer whose latest grift involves targeting real estate investors and offering to stop his alleged smear campaigns in exchange for money. 

Kostecki is a Polish-born, Colorado-based entrepreneur whose 20 years of experience included time spent as “a bad actor,” according to his website. 

LPWhisperer started tweeting about Everett and Dallas-based syndicator S2 Capital in July. In a series of posts, the account accused Everett of stealing from investors and using the money to fund his lavish lifestyle; Everett denies these allegations. 

One post included photos of Everett’s wife on a luxury vacation sporting designer clothing. The caption read: “This is where your money is going right now.”

Everett claims LPWhisperer said it would not stop unless Everett bought the account. 

He’s requesting damages and an injunction that would require Kostecki to remove the tweets and forbid him from repeating them. 

When asked about the lawsuit via direct message on X, LPWhisperer claimed to not know anything about it and denied the connection between Kostecki and the account. 

“I’ve never been in touch with Jake Kostecki,” the account replied. 

Everett did not immediately respond to a request for comment. 

The lawsuit claims the identity of LPWhisperer was revealed after Chris Powers — CEO of Fort Capital and another LPWhisperer target — hired a former law enforcement officer to engage the account, pretending to be interested in bringing a lawsuit against Powers. 

LPWhisperer agreed to provide information about Powers in exchange for $45,000, the lawsuit alleges. The wiring information he provided was traceable to Kostecki’s children. 

LPWhisperer has repeatedly denied that Kostecki is behind the account. 

Regarding the wiring instructions, LPWhisperer claims he was aware of the sting operation and faked a connection to Kostecki.

Kostecki was the subject of a class action lawsuit accusing him of orchestrating a Fyre Fest-esque cryptocurrency conference that he canceled without refunding would-be attendees. The plaintiff in that case secured a default judgment against Kostecki.
