Main summary
Sean “Diddy” Combs urged a judge to cancel his conviction for prostitution positions or, otherwise, he will ask for a new trial, claiming that his conviction was “unconstitutional” and that sexual acts in the center of the two -month trial did not constitute interest prostitution for commercial purposes.
Key data
- The combs lawyers affirmed, in a legal document presented on Wednesday night, that they believe that he is the “only convicted person” under the Mann Law (a Federal Law against Sexual Trafficking) that he had no “commercial motive” and that the sexual acts involved adults who consent.
- They argued that combs did not obtain economic benefit from the alleged prostitution and that the payments made to companions were transactions with legal businesses, so they demanded that the court grant “an acquittal or, at least, a new trial only for the positions under the Mann Law.”
- The lawyers described the sexual presentations known as “Freak-Off” that ComBs recorded on video (key element of the testimony of their ex-girlfriend Cassie Ventura) as forms of “amateur porn” that were “creative, complex and highly choreographed”, protected by the first amendment.
- The writing reintroduces an argument sustained by the defense during the trial: that “combs, at most, paid for participating in voyeerism as part of a ‘swinger'” lifestyle, which – according to their lawyers – does not equal prostitution and is not illegal.
- The presentation was made a day after his lawyers asked the judge to release him under a bail of 50 million dollars, while waiting for his sentence scheduled for October.

Will Trump pardon Diddy?

However, the Deadline media reported Tuesday that Trump is “considering it seriously”, citing an anonymous source of the administration. In May, when he was asked if he would pardon him, Trump replied that “he would analyze the facts” and added that he had not spoken with the musical producer since he entered politics. According to Rolling Stone, members of the combs team would have approached Trump’s allies to explore a possible pardon, although Fuentes pointed out that Trumpist officials doubted due to the severity of the positions. What was condemned to comb?
On July 1, at the end of his two -month judgment, Comink was declared guilty of two of the five federal positions: both for transport for prostitution – one related to Ventura and another to another ex -girlfriend who testified under the pseudonym of “Jane.” The prosecutors argued that combs transported their ex-girlfriends already male sex workers through state lines to participate in marathon sexual sessions type “Freak-Off” or “Night Hotel”, driven by drugs. He was acquitted of the most serious positions: two of sexual trafficking and one of conspiracy for organized crime. He declared himself not guilty of all charges. He still faces a prison sentence, but having been acquitted from the most serious charges saved him from a possible life imprisonment. Each transportation for prostitution purposes involves a maximum penalty of 10 years, although prosecutors have indicated that they will ask for between 4 and 5 years, according to federal guidelines. The defense seeks a slightest sentence of approximately two years.

What is coming
The combs sentence is scheduled for October 3. A judge already denied the bail, citing as proof a surveillance video of 2016 that shows Comps assaulting Ventura in a hotel in Los Angeles, which – according to the judge – indicates that he could represent a danger to society.
