Although the Oaxacan of Mixteco origin, Hugo Aguilar, related to Morena, is emerging as the next president of the Supreme Court of Justice of the Nation (SCJN), according to the preliminary results released of the first judicial election, President Claudia Sheinbaum said this morning that they “told her” of a constitutional “preference” for women.

“Today they were telling me, I did not have it present, because it has to evaluate the INE who is going to be (the president of the SCJN) because in the Constitution there is also a preference part for women,” he said.

Sheinbaum highlighted the possible arrival of Aguilar as a very important change, however, he said that “the INE has to do with who the president or the president would be, but it gives us pleasure, the truth, there had been no representation of an indigenous, of a person of native peoples, Jesus (Ramírez) told me today, from Juarez or the ‘Nigroment’, then, because it is a deep change.”

With almost 88% of the minutes computed by the National Electoral Institute (INE), Aguilar headed the vote with 5.2% of the votes, ahead of the current ministers of the SCJN, Lenia Batres and Yasmín Esquivel, also close to the ruling party Morena.

Some local media have stressed that Aguilar would be the second president of indigenous origin of the Court since in the nineteenth century that position Juárez, who was also ruler of the country and is considered one of the emblematic figures of national history for its social reforms.

Born in Oaxaca and a graduate and teacher in law, Aguilar has been Undersecretary of Indigenous Rights of the Oaxaca Government, general coordinator of indigenous rights of the National Institute of Indigenous Peoples (INPI) and consultant of the Office in Mexico of the United Nations High Commissioner for Human Rights.

Before the vote, he said he had not planned to use the traditional Minister of the Court, but an indigenous gala costume, and clarified that he does not intend to violate the solemnity of the position, but to give an image of multiculturality to the institution.

After Sunday’s elections, the Supreme Court will have nine ministers instead of the previous 11. In addition, its presidency will fall on the candidate who obtains the greatest vote and, every two years, he will be replaced by the one that followed him in the elections.

In an interview in April with the SDP local media, Aguilar said he supported the request of former President López Obrador and his successor and political heiress, Sheinbaum, to ask Spain apologies for the conquest of the current Mexican territory in the 16th century.

About 23 million Mexicans (around 19%) are considered indigenous, according to the last national census, of 2020. However, the group faces poverty and low political representation.

Some indigenous communities usually apply their own traditions within the limits of Mexican law, but conflicts have emerged due to issues of uses and customs such as child marriage and ancestral territorial rights, which come into conflict with large infrastructure projects.
