The Government of Mexico on Wednesday sent a diplomatic note to the United States to request that the death of Ismael Ayala-Uibe, a 39-year-old Mexican who died in a California hospital, was investigated while he was in custody of the immigration and customs control service (ICE) (ICE)

“A diplomatic note was sent on this case requesting that all investigations be done and that if there is any responsibility for human rights violation be sanctioned,” said Mexican president, Claudia Sheinbaum, during her morning press conference.

The president referred to the case of the Mexican migrant who died on September 22 at the Victor Valley Global Victorville Medical Center, located to the Northeast of Los Angeles.

According to the information, Ayala-Uibe was detained at the ICE processing center in the Californian town of Advance and was transferred on September 21 to the medical facilities for “a more exhaustive evaluation” of an abscess in the buttock, after which surgery was scheduled to treat it.

In the early hours of September 22, Ayala-Uibe was found unconscious and was declared dead.

The causes of death have not yet been revealed but are being investigated; ICE said that Ayala also presented abnormal hypertension and tachycardia.

ICE faces several judicial processes due to the lack of necessary medical care provided to detainees.

In this regard, Sheinbaum said that his government supports Mexicans and Mexicans living in the United States, in case of human rights violations, through consulates that help with lawyers so that the nationals submit the corresponding complaint.

He also said that Mexico has sent other diplomatic notes to the US, as in the case of Michoacano Silverio Villegas, who lost his life during an operation of the United States Immigration and Customs Control Service (ICE) of the United States on September 12 in Franklin Park, Illinois.

“We send the same diplomatic note for the investigation to take to its last consequences and we are supporting the family,” he said.

Ayala’s death adds to that of Honduran Santos Reyes Banegas, 42, who died in the Nassau County Center Correctional Center in East Meadow, east of the city of New York, for an alleged failure of the liver.

Reyes Banegas died on September 18 just eighteen hours after arriving at the detention center, where “by protocol went through a medical review” that declared it admissible the previous day, said the government agency.

The deaths of the Mexican and the Honduran are added to the sixteen deaths of migrants already officially recognized by the ICE so far from fiscal year 2025, which began in October 2024, which already exceeds the twelve registered throughout the previous fiscal year.
