The Tabasco Congress decriminalized abortion until 12 weeks gestation and pointed out as entity number 24 of the country in guaranteeing sexual and reproductive rights.

The decision responds to a judgment of the Supreme Court of Justice of the Nation (SCJN) that orders the state congresses to harmonize their laws with the constitutional criteria in the field of reproductive rights and the collegiate court in criminal matters of the tenth circuit that resolved an amparo on the issue.

With 33 votes in favor, one against and an abstention “The Congress of Tabasco decriminalized abortion until 12 weeks gestation. One more step towards the guarantee of reproductive rights,” said the Secretariat of Women of the Government of Mexico in a message on social networks.

According to the opinion, one to three years in prison will be applied to those who cause abortion with the consent of the woman, and from six months to three years to the woman who seeks it for itself, when the pregnancy exceeds 12 weeks.

Meanwhile, the Organization Group of Information in Chosen Reproduction (Turn), a Mexican civil organization founded in 1992 that is dedicated to the defense of reproductive rights, recalled that on April 4 the Collegiate Court in Criminal Matters of the Tenth Circuit resolved the amparo in revision 153/2023 and declared unconstitutional the articles that absolutely prohibit the voluntary abortion in the Criminal Code of Tabasco.

In addition, he ordered the local congress to repeal the crime of self -procured and consented abortion. This day, the Tabasco Congress, attending the order of the Collegiate Court, decriminalized abortion during the first 12 weeks of gestation.

With this action of the Tabasco Congress, the NGO said, there are already 23 of the 31 states of the country and the capital of Mexico City that have decriminalized abortion as a voluntary decision before week 12 (and in Sinaloa, 13).

These laws are in tune with the court ruling that in 2021 determined that prohibiting the interruption of pregnancy violates the rights to human dignity, reproductive autonomy, health and equality, among others.

This Wednesday, the Justice Commission of the Guanajuato Congress rejected the initiative to decriminalize abortion, which will be discussed next week in the legislative’s plenary session.

Mexico City was the first entity of the country to decriminalize, in 2007, abortion until week 12, although recently the Congress of the capital put on the table the elimination of the deadline to abort, which contributes to criminalization and stigma and affects the most vulnerable.

As of 2019, the decision of Mexico City was adopted by the states of Campeche, Chihuahua, Nayarit, Oaxaca, Veracruz, Hidalgo, Baja California, Colima, Guerrero, Baja California Sur, Quintana Roo, Aguascalientes, Sinaloa, Jalisco, San Luis Potosí, Puebla, Michoacán, Zacatecas, State of Mexico. Coahuila, Yucatán and Tabasco.
