The full Senate approved the reform to the Federal Consumer Protection Law so that subscribers of digital services are notified by providers, at least five calendar days in advance, about the automatic renewal.

The minutes, sent by the Chamber of Deputies, allow the subscriber to cancel the service without penalty.

Providers are obliged to guarantee simple, fast and free mechanisms for the immediate cancellation of services, without unjustified penalties, according to a statement from the Senate.

With approval, the project was sent to President Claudia Sheinbaum for her decree.

The reform establishes that “the provider must inform in a clear, prominent and accessible manner if the contracted service involves recurring automatic charges, their frequency, amount and date of payment.”

The changes aim to strengthen the rights of consumers in the digital environment, incorporating new obligations for providers of goods and services that offer subscriptions or memberships with automatic payment.

The reform aims to give the consumer greater control over their subscriptions, memberships and services, preventing unwanted automatic renewals and improper charges.

The president of the Consumer Defense Commission, Cinthia López Castro, highlighted that the initiative arose due to the growth of electronic commerce and the need to safeguard the digital rights of consumers.

He said that, according to Profeco data, in 2024 more than 20 thousand complaints were registered related to digital services and automatic subscriptions, mainly on streaming platforms, gyms, software and mobile telephony.
