The government of President Donald Trump accused a federal judge of “promoting the ideological fanaticism of gender” for ordering liberation to a transgender Mexican immigrant detained in a migratory prison for men in the state of Washington.
The Department of National Security (DHS, in English) lashed out at Judge Amy Baggio, appointed for the position in Oregon by former president Joe Biden (2021-2025), and accused her of giving it up to the pressure of pro-immigrants and transgender activists ”ignoring the rule of law” and promoting the fanaticism of gender ideology, he said in a statement.
Baggio ordered the release of Odalis Jhonatan Martínez Velásquez from the detention center of the Immigration and Customs Control Service (ICE) in Tacoma (Washington).
The immigrant irregularly entered the country in 2023 and was released under the Biden administration to fight for its asylum case.
The Mexican claims to have been kidnapped and raped due to her gender identity by members of the Caballeros Templar Cartel in Mexico in 2021, according to judicial documents cited by Dailly Caller.

Trump’s government criticizes the judge who released Transgender Mexican imprisoned with men
Martínez Velásquez was arrested on June 2 after an immigration judge dismissed his case and sent to the section destined for men the Tacoma Center waiting for its accelerated deportation.
In a statement DHS said that the Mexican was placed in a male “conformity” detention center with the executive order of President Trump and for “women’s safety” under the government’s custody.
“The president made it clear from the first day: the DHS will not accept radical gender ideologies by arresting undocumented immigrants,” DHS Tricia McLaughlin said in a statement.
The Undersecretary stressed that she is an immigration judge, not a district judge, who has the authority to decide whether Martínez Velásquez must be released or detained.
“The ‘activist’ judge ignores the biological reality of sex, undermines ICE commitment to promote safe environments,” added the official.
In the United States, immigration judges are part of the Executive by being under the discretion of the Department of Justice.
