The case of Mexican Anastasio Hernández Rojas, dead at the hands of border patrol agents, will be analyzed by the UN as part of the organization’s reviews to establish whether or not the United States complies with its obligations under human rights treaties.

The Human Rights Clinic of the Faculty of Laws of the University of California Berkeley and Alliance San Diego (ASD) said Monday that they have submitted a report on the death of the immigrant with which they seek to expose the serious deficiencies that exist in the country in human rights.

Hernández Rojas, a construction worker who had lived for more than 20 years in the US, died on May 28, 2010, after more than a dozen were officers of the Border Patrol hit him repeatedly and subjected him to multiple electrical discharges.

The immigrant was handcuffed and subjected, with kneeling officers on his neck and back while supplying for help, as recorded in at least two videos captured by witnesses.

The death of Hernández Rojas was classified by the coroner as homicide.

This case is the first to question the American standard for the use of the force of its migratory agents under the “objectively reasonable” perspective, the lawyers of the organizations representing the immigrant family.

“Due to this lethal and poor standard, American border agents managed to get out of their hitting, kicking, electrocuting and brutally torturing Anastasio (Hernández Rojas),” adds the press release, which stresses that no agent involved or its superiors paid accounts.

The delivery of evidence to the UN on the case of Hernández Rojas occurs at a time when the United States government is expanding the powers of agencies such as the Office of Customs and Border Protection (CBP), the agency of application of the largest law in the country.

“It is more important than ever to testify to the damage that is being caused and demand responsibilities,” said lawyers in the statement.

They added that Mexican death makes it clear that human rights are not properly protected in the US.

The UN Human Rights Council will analyze the evidence presented as part of the universal periodic examination, a process to which all UN Member States must be submitted.

The case of Hernández Rojas is currently evaluated by the Inter -American Commission on Human Rights (IACHR), which although it has no power to sanction the US government, it could issue a ruling in favor of immigrant’s relatives and formulate a series of recommendations to avoid repeating police abuse incidents at the border.

The UN will issue a general report next November, when the IACHR could have already given its verdict.
